GENERAL TERMS
1) These Terms of Sale apply to the rights and obligations arising from the purchase of goods between the customers of the Shopmaailm.ee online store (hereinafter referred to as the Client) and VITKAR GROUP OÜ (hereinafter referred to as Shopmaailm.ee).
2) By registering as a user of Shopmaailm.ee and/or for purchasing products, the terms of this agreement and the rights and obligations arising from the legal acts of the Republic of Estonia apply.
3) Shopmaailm.ee reserves the right to make changes to the terms of sale and selling prices. The aforementioned changes will be reflected on the Shopmaailm.ee website.
ENTRY INTO FORCE OF THE SALES AGREEMENT
1) Shopmaailm.ee sells, and the Client purchases the products offered in the e-shop.
2) The sales agreement between Shopmaailm.ee and the Client enters into force from the moment the amount payable according to the order confirmation is received in the bank account of VITKAR GROUP OÜ.
3) By placing an order and making a payment in the Shopmaailm.ee online store, the Client confirms that they have reviewed the terms of sale and agree to them.
PRICES
1) All prices in the Shopmaailm.ee online store are in euros and do not include the cost of delivery.
2) Shopmaailm.ee reserves the right to adjust prices. If the Client submitted their order before the price changes took effect, the price reflected on the invoice at the moment the order was placed shall apply. The Client has no right to demand compensation for the difference in price.
PLACING AN ORDER AND PAYMENT FOR GOODS
1) When paying for the order, the Client can choose a suitable payment method. The Client pays 100% of the order sum to confirm the order.
2) The sales agreement is considered concluded and the fulfillment of the order begins immediately after the Client has paid 100% of the order confirmation amount.
3) Pay Later (The order total must be 30 euros or more).
Choose Montonio Split as the payment method in the shopping cart and pay for the entire purchase only after 30 days. Without any extra fees: 0% interest, 0 € contract fee, and 0 € administration fee.
DELIVERY
1) After the sales agreement enters into force (the Client's payment of the invoice), Shopmaailm.ee prepares the order and hands it over to our logistics partners for delivery.
2) The delivery times shown on the Shopmaailm.ee website are valid from the moment the invoice is paid.
3) Should the destination or the agreed-upon time change, the Client is obliged to notify Shopmaailm.ee immediately before the goods are delivered.
4) Avoiding delays and misunderstandings in goods delivery depends on the accuracy and correctness of the data provided in the order. Shopmaailm.ee is not responsible for delays in product delivery or misunderstandings that arise if the delay or misunderstanding is caused by the inaccuracy of the data provided by the Client when placing the order.
5) Shopmaailm.ee is not responsible for a delay in the delivery of the goods if the delay is caused by circumstances that Shopmaailm.ee could not influence or foresee.
RIGHT OF RETURN
1) In accordance with § 56 section 1 of the Law of Obligations Act (VÕS), the Client has the right to withdraw from the contract within 14 days from the receipt of the goods.
Please notify us immediately after receiving the order.
2) The returned goods must be unused, undamaged, and in the original packaging.
3) When returning the goods, package the item correctly. In case of damage to the sales packaging or the product itself, the item is not eligible for return.
4) Products whose use (or non-use) cannot be verified are not eligible for return. The 14-day right of return does not apply to goods that by their nature cannot be returned for health protection or hygiene reasons. Food products are not eligible for return.
5) The costs of returning the goods shall be borne by the client, except in cases where the reason for the return is non-compliance with the order or a defective item.
If the purchase included free delivery, in case of a return, the buyer is responsible for the postage costs.
6) To return the goods, a free-form application for the return of goods must be submitted to the email address info@shopmaailm.ee within 14 days from the receipt of the goods. The return application must include the Client's name, the product name, and the invoice or order number.
7) Money for the returned goods will be reimbursed to the Client immediately, but no later than 14 days after receiving the withdrawal application. In addition to the cost of the returned goods, the delivery costs of the goods will also be refunded.
PROCEDURE FOR SUBMITTING CLAIMS
1) In accordance with the Law of Obligations Act, the Client has the right to submit claims for non-conformity with the terms of the contract found in the product within 2 years from the receipt of the goods. For defects occurring within the first six months, it is presumed that the defect existed at the time of purchase, and the seller must determine the nature of the defect.
2) Should a product defect appear, the Client is obliged to notify Shopmaailm.ee of the problem by email at info@shopmaailm.ee and provide the following information: name, contact details, and the product defect. The corresponding application must be sent no later than 2 months after the discovery of the defect.
3) Shopmaailm.ee is not responsible for:
– for damage to the product caused by the client's fault or negligence;
– for defects that have arisen as a result of improper use of the product;
– for the natural physical wear and tear of the product during normal use.
LIABILITY AND FORCE MAJEURE
1) Shopmaailm.ee is liable to the Client, and the Client is liable to Shopmaailm.ee for damage caused to the other party by the violation of these terms, in the cases and to the extent established by the legal acts in force in the Republic of Estonia.
2) Shopmaailm.ee is not responsible for damages caused to the Client or for the delay in product delivery if the damage or delay in product delivery is due to circumstances that Shopmaailm.ee could not influence or foresee.
PRIVACY
1) By using the Shopmaailm.ee website, the Client gives Shopmaailm.ee clear and informed consent for the processing of their personal data.
2) Shopmaailm.ee uses the information provided by the Client only for the fulfillment of the Client's purchase order and does not disclose it to third parties.
OTHER TERMS
1) Disputes and disagreements arising from the fulfillment of these terms shall primarily be resolved by the parties through negotiations. If disputes arising from the Agreement cannot be resolved through negotiations between the parties, the Client has the right to turn to the Consumer Protection Board or a Court for the protection of their rights. Shopmaailm.ee has the right to turn to a Court for the protection of its rights.
